ROMA LUCE ITALY COMMERCIAL WARRANTY TERMS

I. PRODUCTS
This limited conventional warranty is issued by Roma Luce Italy.

II. WARRANTY DESCRIPTION AND VALIDITY SPAN
Without prejudice to the legal guarantee, Roma Luce Italy extends the guarantee on manufacturing defects relating to the fixtures supplied up to a period of 5 (five) years from the date of the invoice. Therefore, the total legal and conventional warranty period will be 5 (five) years from the invoice date.
Determining whether the product is defective or not will be the task of Roma Luce Italy in its sole discretion, considering the general performance of the device involved.
A product cannot be considered defective only as a result of a single component’s malfunctioning.
The decrease in luminous flux over time is a known phenomenon in LED devices, therefore it is not covered by the warranty.

III. WARRANTY TERMS AND CONDITIONS
The commercial warranty is valid when:
A. the products are stored, installed, used and maintained in accordance with the technical specifications indicated in the product marking (with specific reference to the voltage and operating temperature), the instructions supplied with the product, what is indicated in the respective catalogues and rules in force;
B. installation and maintenance are performed by qualified technical personnel;
C. the reported defect affects the functionality of the product;
D. the product has not been modified, altered or treated with chemical agents in any way without authorization from the manufacturer;
E. the product covered by the guarantee is made available to Roma Luce Italy for further checks/tests for the time necessary to determine its cause and/or veracity;
F. the defect is reported in writing, by official e-mail, to Roma Luce Italy within 90 (ninety) days from the date of receipt of the products (in case of apparent defects) or from the discovery of the defect (in case of hidden defects) by sending a photographic feedback of the code on the product.
In the event that the defect is recognized by the manufacturer, Roma Luce Italy will choose at its discretion whether to repair or replace the defective product with the same product or an equivalent one, taking into account the technical evolution of the products and that of their components. Any technical intervention or replacement (partial or complete) of
the product carried out pursuant to the warranty will not in any case give the right to extensions or renewals of the same beyond 5 (five) years from the date of the invoice. The repair/replacement of the item involved will not include the costs of shipping/installing the device.
Roma Luce Italy is not responsible for, and therefore will not reimburse, any consequential loss or indirect, compensatory or other damage, suffered due to a defective product, such as, by way of example and not limited to, shipping costs and/or custom clearance costs, assembly costs, on-site installation costs, any downtime costs, loss of profit or overall costs of the buyers.

IV. EXCLUSIONS AND LIMITATIONS

This limited conventional warranty does not cover:
A. labour costs and expenses, equipment and warehouse costs and expenses, or any other additional costs relating to and/or resulting from any intervention necessary to repair the defect (such as, by way of example, costs/expenses for assembly, disassembly and transport of defective devices, to be repaired or new products, which will be the sole responsibility of the customer);
B. electrical components subject to wear which are similar to consumables (such as lamps, lighters, batteries, etc.);
C. products made on specific customer request;
D. damage to the product requested due to negligence, transportation or unexpected and unforeseeable events that do not fall within the normal conditions of use referred to in point 3 A (such as, for example, electric shocks and lightning);
E. products that are turned on for more than 4,000 hours per year;
F. appliances not used for the purpose for which they were made.
This warranty does not guarantee the integrity of the paintwork when the product is used in an environment salty or in the presence of corrosive agents.
In no case Roma Luce Italy will be responsible for accidental, compensatory, consequential, indirect, special or other damages. The liability of Roma Luce Italy for a product defect will in any case be limited to the amount actually paid for that defective product.
This conventional warranty is the only warranty provided by Roma Luce Italy and is granted with the exclusion of all other warranties, explicit or implicit, such as, for example, guarantees of merchantability or fitness for a particular purpose. The exclusive remedy of the buyer for any non-conformity or defect of a product will only be that explicitly provided for in this guarantee.
The performance and duration of the LEDs are not guaranteed if the luminaires are installed in environments with the presence of chemicals that are not compatible with the LEDs themselves. Our technical department is available to check the compatibility of the LEDs we use in relation to the substances present in the environment where the luminaires are installed.
This warranty applies to the domestic and foreign market.

V. TECHNICAL DISPUTES
In the event of a technical dispute, the parties will submit the disputed product to a contractual report by a third party expert. The expert's evaluation will be binding on both parties. The costs relating to the mentioned contractual appraisal will be borne by the parties in an amount of 50% each.

VI. APPLICABLE LAW AND COMPETENT COURT
This limited conventional warranty, as well as its execution, interpretation and all questions concerning the validity and effectiveness of the same, will be governed by Italian law and subject to Italian jurisdiction.
